Buying land or a house in Thailand is an attractive and sound investment and also, it’s for your life-style, residence or retirement purposes. Similar to other Asian and some European countries, foreigners are restricted to buy the land directly here, however, apart of that, thousands of foreigners do effectively own properties in Thailand with no issue at all. Foreign individuals are legally able to directly own (on a freehold basis) apartments in condominiums and any separate buildings including villas and other property. The land under your property could be owned on a leasehold basis, which means be leased from the developer for 30 years with possible additional lease agreements for the next 30 and 30 years, with which makes total of 90 years of actual ownership of the land provided you’ve got properly drafted contracts. A 90-year initial lease is also being considered now by Thai legislators to attract more foreign investors.
We, at Vista del Mar, offer a freehold/full ownership for the villa (building) and separate lease agreements for 30+30+30 years for the land plot under your villa with our development company, the landowner. We include in our contracts guarantees to freely rent out your property, to resale/reassign to any third party, and transfer by inheritance of your property and property rights at any time at your own discretion. So finally, you’ve got a Sales and Purchase contract for your villa and a Lease contract for the land plot, both officially registered with the Phuket Land Department on your name, with copies of registration kept in the government register, as confirmation of your property rights.
There is also an option to buy the land freehold for the name of a company, but we do not recommend it in most cases.
To own the property, to enjoy it several times a year for a couple of months or to rent it out, you do not need any special visa or residency permit. Should you want to live here more or less permanently, there are multiple options to get long term visas depending on your age, business and travel plans.
